1. Agreement and operator
These Terms form an agreement between you and Birdie Breaks LLC, doing business as Palm Proxy (“Palm Proxy,” “we,” or “us”). By creating an account, purchasing, topping up, or using the services, you agree to these Terms and the Acceptable Use, Privacy, and Refund Policies. You must be at least 18 and legally able to enter this agreement.
2. Accounts and security
You must provide accurate account information and protect your login and proxy credentials. You are responsible for activity performed through your account or credentials. Notify Palm Proxy support promptly of suspected unauthorized access. Accounts and credentials may not be sold, sublicensed, publicly posted, or shared outside your authorized team.
3. Services and metering
Palm Proxy provides access to residential, mobile, and dedicated ISP proxy infrastructure. Bandwidth products are metered by the upstream network. Dedicated IP products are provided for the stated term. Locations, carriers, IP availability, performance, compatibility, and success rates can change and are not guaranteed. “Top up” adds eligible bandwidth to an active plan; it does not create a new credential set.
4. Purchases and pricing
Prices and eligible discounts are calculated by Palm Proxy’s server and confirmed at checkout. You authorize Whop and its payment providers to process the displayed charge. Taxes may be added where required. Attempts to alter prices, payment metadata, discounts, quantities, or fulfillment records are prohibited and may result in cancellation or suspension.
5. Responsible use
You may use the services only for lawful purposes and in compliance with the Acceptable Use Policy, applicable laws, and third-party rights. You are responsible for determining whether your intended use complies with a destination website’s terms and applicable law.
6. Suspension and termination
We may suspend or terminate access to protect customers or networks, investigate abuse, comply with law or provider requirements, address nonpayment, refunds or disputes, or enforce these policies. Suspension does not create a right to a refund where the activity violated these policies.
7. Availability and disclaimers
The services are provided “as is” and “as available.” To the fullest extent allowed by law, Palm Proxy disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and uninterrupted availability. We do not guarantee that a proxy will work with every destination or produce any commercial result.
8. Limitation of liability
To the fullest extent permitted by law, Palm Proxy will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Palm Proxy’s aggregate liability arising from the services will not exceed the amount you paid Palm Proxy for the affected service during the three months preceding the event giving rise to the claim. Some jurisdictions do not permit every limitation, so applicable rights remain.
9. Indemnification
You agree to defend and indemnify Palm Proxy and its personnel against third-party claims, losses, and reasonable costs arising from your unlawful use, policy violation, infringement, or misuse of credentials.
10. Changes and governing law
We may update these Terms prospectively by posting a new version and requiring renewed acceptance when material. Kansas law governs these Terms, without regard to conflict-of-law rules. Courts with proper jurisdiction in Kansas will hear disputes unless applicable law requires otherwise.
